These Terms of Use ("Terms") govern your access to and use of Lemma Analysis (the "Service"), an analytics terminal for independent investors. By using the Service you agree to these Terms. Please read them carefully.
The Service is operated by Vadym Andrijovyč Pantěljejenko, a self-employed entrepreneur registered in the Czech Republic (IČO: 23514591), with registered address at Malodrážní 159/12, 417 31 Novosedlice, Czech Republic ("Lemma Analysis", "we", "us", "our").
By accessing or using Lemma Analysis, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
You represent that you are legally able to enter into this agreement. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it.
The Service is available only to individuals who are at least 18 years old. It is not directed to children, and we do not knowingly allow anyone under 18 to create an account or use the Service.
By creating an account — with a password or through a sign-in provider — you confirm that you meet this age requirement; the consent line under the sign-in buttons says so, and pressing one of them is that confirmation. If we learn that an account belongs to someone under 18, we will close it and delete the associated data. If you believe a minor has created an account, contact us at support@lemma-analysis.com.
We may modify the Service or these Terms at any time. When we make material changes we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
All content on Lemma Analysis — including profiles, statistics, quotes, screeners, calculators, valuation models, portfolio analytics, and any figures, ratings, or signals — is provided for informational purposes only and is impersonal. It does not take into account your individual objectives, financial situation, or needs.
Nothing on the Service is a recommendation to buy, sell, or hold any security, and nothing on the Service constitutes investment, legal, tax, or accounting advice.
Lemma Analysis is a research and analysis tool, not an investment adviser, broker, or fiduciary. Tools such as calculators, the discounted-cash-flow model, screener, watchlists, and portfolio analytics produce outputs from the inputs and assumptions you or third parties provide; those outputs are estimates, not guarantees.
We are not responsible for any errors in your manual inputs, incorrect assumptions, or the accuracy of third-party data used in calculations. Outputs of any tool or calculator may contain computational, methodological, or data errors, and you should independently verify any figure before relying on it.
You are solely responsible for your own investment decisions and for evaluating the merits and risks of any transaction. You should consult a qualified professional before making financial decisions. Past performance is not indicative of future results.
Some tools, features, or calculators may be provided on a "beta" or "experimental" basis. Such features may not be fully tested, may contain errors or produce inaccurate results, and may be modified, suspended, or discontinued at any time without notice. Beta and experimental features are provided without any commitments or warranties of any kind, and your use of them is at your own risk.
The Service and its contents — including software, text, design, and graphics — are owned by Lemma Analysis or its licensors and are protected by intellectual-property laws. You may access and use the Service for your own personal, non-commercial use.
You may not copy, reproduce, republish, scrape, redistribute, or create derivative works from the Service or its data without our prior written permission. Lemma Analysis and its logo are trademarks of Lemma Analysis; other marks are the property of their respective owners.
You agree not to:
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date, and to notify us promptly at support@lemma-analysis.com of any unauthorized use. We are not liable for losses arising from your failure to safeguard your credentials.
The Service may let you submit content such as notes, journal entries, watchlists, saved screens, and scenarios ("Submissions"). You retain ownership of your Submissions.
By submitting content, you grant Lemma Analysis a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process it as needed to operate and improve the Service. You represent that you have the rights to your Submissions and that they do not violate any law or third-party right.
We may, but are not obligated to, monitor, edit, or remove any Submission at our discretion, including content we consider unlawful, offensive, or otherwise objectionable. We do not guarantee the accuracy, integrity, or quality of any user-submitted content, and you may be exposed to content you find inappropriate.
We respect the intellectual-property rights of others. If you believe that content available on the Service infringes your copyright, please send a notice to support@lemma-analysis.com that includes:
Upon receipt of a valid notice, we will review the claim and, where appropriate, remove or disable access to the allegedly infringing material. We may terminate the accounts of users who repeatedly infringe the rights of others.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding the accuracy, completeness, timeliness, or reliability of data. We do not warrant that the Service will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, Lemma Analysis and its affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or investment losses, arising from your use of or reliance on the Service. Our aggregate liability for any claim will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection provisions.
You agree to indemnify and hold harmless Lemma Analysis and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your Submissions, or your violation of these Terms or any law or third-party right.
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the Service at any time. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
Certain features require a paid subscription. Fees, billing cadence, and the features included in each plan are described at checkout.
Payments are processed by Lemon Squeezy, LLC, acting as our merchant of record. When you purchase a subscription, the transaction is completed with Lemon Squeezy, which handles payment processing, applicable taxes (such as VAT or sales tax), invoicing, and refunds in accordance with its own terms of service and refund policy. By subscribing you authorize Lemon Squeezy to charge the applicable fees to your payment method on a recurring basis until you cancel.
Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and access continues until then. There is no prorated refund for partial periods: cancelling part-way through a monthly or annual term does not entitle you to a refund of the unused portion, and fees already paid are otherwise non-refundable. This applies without prejudice to mandatory statutory rights, including the EU/EEA right of withdrawal described immediately below. We may change plan pricing on prospective renewals with advance notice.
Consumers in the EU/EEA — right of withdrawal. If you are a consumer resident in the EU or EEA, you have a statutory right to withdraw from your subscription within 14 days of the day the contract is concluded, without giving any reason. To exercise it, send an unambiguous statement to support@lemma-analysis.com before that period expires; you may use the model withdrawal form in Annex I of Directive 2011/83/EU, but you are not obliged to. We will reimburse you without undue delay and no later than 14 days after being informed, using the same means of payment you used.
Paid features become available as soon as the subscription starts. If you withdraw within the 14-day period, we nevertheless refund the full amount you paid for that subscription: we do not deduct anything for the days on which the Service was available to you. Nothing in these Terms — including the no-prorated-refund rule above — limits, waives or is intended to circumvent this right or any other mandatory statutory right you have as a consumer.
The Service displays market data, quotes, fundamentals, and other information sourced from third-party providers. Such data may be delayed, incomplete, or inaccurate, and is provided subject to those providers' terms. Lemma Analysis does not guarantee the accuracy or timeliness of third-party data and is not liable for any loss arising from reliance on it. You may not redistribute third-party data except as expressly permitted.
The Service can import transactions from a brokerage account you connect. You issue the access credential yourself, at your broker, and hand it to us; we never ask for, and you must not provide, your brokerage login or password. You are responsible for the credential being permitted under your own agreement with your broker, for the scope you give it, and for revoking it when you no longer want the connection — at the broker, or by disconnecting the account in Settings, which deletes the credential from our systems immediately.
The credential must be read-only. We use it solely to read your account’s transaction history and to record those transactions in your portfolio, on your instruction. We place no orders, transfer no funds and change nothing in your brokerage account, and nothing in the Service is built to do so. Do not provide a credential that permits trading or withdrawals; if you do, you do so at your own risk.
Data received from your broker is third-party data, and the caveats in Third-Party Market Data apply to it: it may be delayed, incomplete or inaccurate, and it is subject to your broker’s own terms, availability and limits. A sync runs only while the credential is valid and the broker’s service answers. A sync that does not run, does not complete or is refused by the broker does not make us liable for a portfolio that is out of date; you remain responsible for checking your portfolio against your broker’s own records before relying on it.
Your broker is not our subcontractor: it processes your data under its own agreement with you. What we store about a connected account, and for how long, is described in our Privacy Policy.
These Terms are governed by the laws of the Czech Republic, without regard to its conflict-of-laws rules. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the jurisdiction of the courts of the Czech Republic.
If you are a consumer, nothing in these Terms deprives you of the protection afforded to you by mandatory provisions of the law of the country in which you reside, or of your right to bring proceedings in the courts of that country. Czech consumers may also address out-of-court dispute resolution to the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz).
If any provision is found unenforceable, the remaining provisions will remain in full effect. These Terms constitute the entire agreement between you and Lemma Analysis regarding the Service and supersede any prior agreements. Our failure to enforce any right or provision is not a waiver of it.
